| Scope |
| These Hewlett Packard Enterprise Terms and Conditions of Online Sales (the "Terms") apply to orders submitted by you to Hewlett Packard Enterprise online for products and services available in the Hewlett Packard Enterprise Spare Parts Store website (the "HPE Parts Store"). These conditions apply only to consumers who are purchasing products or services for use outside of their trade, business or profession. |

| Prices, Shipping Charges and Payment |
| Prices, shipping charges and payment shall be as specified in the Hewlett Packard Enterprise Parts Store, as determined when ordering online. Hewlett Packard Enterprise reserves the right to change prices published on the Hewlett Packard Enterprise Parts Store at any time. |
| Prices are exclusive of, and Customer shall pay, all taxes, duties, levies or fees, or other similar charges related to Customer's order. No value added taxes refund system for non-EU residents is currently available from Hewlett Packard Enterprise for online purchases. “Delivery location” means the location where Hewlett Packard Enterprise transfers title or possession of Products to Customer or the location where Support is performed or where the Products being serviced are located. |
| Hewlett Packard Enterprise may change credit or payment terms at any time if, in Hewlett Packard Enterprise's reasonable opinion, your financial condition, previous payment record or the nature of your relationship with Hewlett Packard Enterprise so warrants. For credit card orders your account will be debited immediately after shipment from Hewlett Packard Enterprise. |

| Invoicing |
| Invoices will be sent electronically or by post to the address provided on the order. If you do not receive this within ten (10) days please contact us via the Assistance Request Form. |

| Orders |
| You agree that we may use Personal information provided by you in order to conduct appropriate anti fraud checks. Personal Information that you provide may be checked against a credit reference or fraud prevention agency, which may keep a record of that information. |
| All orders are subject to acceptance by Hewlett Packard Enterprise. Hewlett Packard Enterprise will provide you with an order acceptance or rejection notice as soon as reasonably possible. Orders must specify a “ship to” address and have a delivery date within ninety (90) days from the order date. |

| Order Cancellation |
| Hewlett Packard Enterprise reserves the right to cancel any accepted order prior to delivery at Hewlett Packard Enterprise's discretion (whether or not your credit card has already been charged) in the event of any material errors in connection with your order or the price or other conditions published in the Hewlett Packard Enterprise Parts Store relevant for your order, or if any further verification of your credit conditions or records so warrants. If your credit card has already been charged and your order is cancelled, Hewlett Packard Enterprise will immediately issue an appropriate credit to your credit card account. |
| In accordance with your Statutory Rights that shall not be affected hereunder by this agreement, You may change your mind and cancel your purchase at any time before the expiry of the date seven( 7) working days cooling-off period after the products are delivered and receive a full refund. |
| Cancellations may be made by notifying Hewlett Packard Enterprise through the Assistance Request Form. |
| Hewlett Packard Enterprise will collect the products but you will make them available for collection with the original box and packaging to the extent this is still possible together with any accessories and free gifts received with the products. Any software must be sealed and not opened. You must take reasonable care of all products whilst they are still in your possession. |
| If the products were a special order made to your specification, this right of cancellation does not apply. |

| Delivery |
| Orders are delivered as specified in the Hewlett Packard Enterprise Parts Store and determined by you when ordering online. |
| Hewlett Packard Enterprise will deliver Products at the “ship to” address specified in Customer's order within the country in which Hewlett Packard Enterprise accepted the order. |

| Title and Risk of Loss |
| Title to hardware products passes to you upon the later of full payment or delivery of products. Risk of loss and damage pass to you the Consumer upon delivery. |

| Defects on Delivery and Returns |
| You may reject goods as inoperable or defective at the time of delivery by notifying Hewlett Packard Enterprise within 30 (Thirty) days of delivery, which Hewlett Packard Enterprise believes to be a reasonable timeframe in the majority of cases. Requests may be placed through Assistance Request Form. If you reject any products, Hewlett Packard Enterprise shall pick them up and, at your option, either replace or repair them, or refund the amounts you paid for them unless any such remedy is disproportionate or impossible. Hewlett Packard Enterprise may test products upon return and charge you any costs incurred by Hewlett Packard Enterprise if you wrongly claimed that returned products were inoperable or defective. |
| Return of products purchased under a special offer or promotion or as part of a bundle may be subject to specific conditions, as described herein or otherwise communicated to you. No refund is allowed for individual products purchased as part of a bundled or under a voucher promotion jointly with other products, but Hewlett Packard Enterprise will either (i) replace such individual product or (ii) have returned the whole product bundle or the whole order and refund the amounts you paid. Hewlett Packard Enterprise reserves the right to get reimbursement of any promotional discounts applied on other products you purchased if such discounts were dependent on the purchase of the product(s) returned to Hewlett Packard Enterprise. |

| Warranty |
| To the extent that the Hewlett Packard Enterprise's limited warranty is inconsistent with the statutory laws of the country where Hewlett Packard Enterprise has delivered the product(s) or support to you, they are deemed modified to be consistent with such local law. |

| Software Licenses |
| Hewlett Packard Enterprise software products are subject to Hewlett Packard Enterprise's standard license terms posted in the Hewlett Packard Enterprise Parts Store. Non-Hewlett Packard Enterprise software products and, exceptionally, some Hewlett Packard Enterprise software products may be subject to different license terms, as provided with such products. |

| Limitation of the Liability |
| Subject to the following provisions, Hewlett Packard Enterprise's liability is limited to losses that were reasonably foreseeable at the time you purchased the product on these terms from Hewlett Packard Enterprise. |
| Hewlett Packard Enterprise will not be liable for loss of data as it expects you to make appropriate arrangements to back up your data. |
| Hewlett Packard Enterprise does not exclude or limit liability for death or personal injury (including to the extent caused by its negligence), for willful default, for any breach of any undertaking as to title, quiet possession and freedom from encumbrance implied by applicable law, for fraud, fraudulent misrepresentation or any misrepresentation as to a matter fundamental to its ability to perform contractual obligations or for any other liability that cannot be excluded or limited by law. |

| Protection of Personal Data |
| By using the Hewlett Packard Enterprise Parts Store Site, you agree with the terms of the Hewlett Packard Enterprise Privacy Statement attached to the Site. Whenever you submit information via this site, you consent to the collection, use, and disclosure of that information in accordance with this Privacy Statement and agree that any personally identifiable information you provide to us in connection with the Hewlett Packard Enterprise Parts Store may be dealt with by Hewlett Packard Enterprise in accordance with the terms specified in the Hewlett Packard Enterprise Privacy Statement available at the bottom of the Hewlett Packard Enterprise Parts Store web pages. |

| Other applicable terms |
| Sales are governed by the laws of the country and locality of delivery within the European Union (EU) and the European Free Trade Association (EFTA). You must comply with the applicable export licensing laws if you export the products. |
| To the extent that these Terms, Hewlett Packard Enterprise's limited warranty, standard license or Support Pack terms are inconsistent with the statutory laws of the country where Hewlett Packard Enterprise has delivered the product(s) or support to you, they are deemed modified to be consistent with such local law. |
